Guatemala Caught in the Legal Vacuum of Online Gambling

An outdated legal framework

Undoubtedly, the regulation of gambling in Guatemala continues to be one of the most ambiguous in Latin America. Although the Penal Code provides penalties for owners or managers of unauthorized gambling houses, as well as for certain illegal lotteries and raffles, the current regulations were designed in 1880 and do not specifically apply to modern casinos, sports betting, or online gambling.

This legal vacuum has allowed international operators to offer their services to Guatemalan players without a specific licensing or supervision regime.

Online gambling remains unregulated

Unlike other markets such as Colombia or Peru, Guatemala does not yet have a regulatory authority in charge of granting licenses for online gambling.

There are also no specific rules on player protection, responsible gambling policies or technical controls for digital operators, which keeps the country as a market of limited regulation or "grey zone".

Initiative 6645

In parallel to the debate on a comprehensive regulation of the sector, the Guatemalan Congress took an important step to combat the proliferation of slots and other unauthorized games of chance.

The Government Commission, chaired by Deputy Fidencio Lima, issued a favorable opinion on Initiative 6645, a project that proposes to modify the Penal Code to regulate, sanction and prevent the clandestine operation of slot machines and other illegal games.

The initiative seeks to close the legal loopholes that have allowed the expansion of thousands of slot machines installed in shops and neighborhood stores without any type of supervision.

In fact, the text explains that "The proliferation of slot machines and other games of chance in the national territory has caused a series of social, economic and public health problems. The absence of specific regulation that allows preventing, eradicating and punishing their operation has allowed these machines to be installed clandestinely, even in areas near schools, markets and vulnerable communities, violating the rights of citizens, particularly children and adolescents."

More control and greater collection

According to the Commission's opinion, the proposal does not contradict the Constitution, but rather strengthens the legal framework by addressing a problem that affects both the Guatemalan economy and society.

Among its main objectives are to increase tax collection, combat tax evasion and protect public resources destined for areas such as health, education and security. In addition, the project warns about the social risks associated with illegal gambling and the need to strengthen controls to protect the most vulnerable sectors and prevent the access of minors to these activities.

Therefore, Initiative 6645 explains that "with the primary purpose of preventing, eradicating and punishing the operation of such slot machines and games of chance, this initiative aims to regulate the matter, finding its basis in the following constitutional principles and mandates".

Attempts to modernize the sector

Prior to Initiative 6645, Congress had promoted Initiative 4294, which proposed to create a Law for the Regulation of Betting, Casinos, Video Lotteries, Bingo and Games of Chance. However, despite advancing in the legislative process, the project was never approved.

The new initiative represents another attempt to update the legislation, although its scope is mainly focused on combating illegal gambling and not on establishing a comprehensive regime for the online market.

The pending challenge

Specialists agree that Guatemala still needs a broader reform that allows regulating online betting through a licensing system, establishing responsible gambling rules, strengthening the prevention of money laundering and providing greater legal certainty to both operators and players.

To conclude, it should be noted that until this legal framework is approved, the country will continue to be among the Latin American markets with the greatest regulatory uncertainty for the digital gaming industry.
