Italy focuses on the supervision of public gambling with new regulations

A new instance to monitor the market

Italy made progress in the implementation of its gambling reform with the entry into force of Ministerial Decree No. 90, approved on 6 March 2026 and published in the Gazzetta Ufficiale on 22 May. The regulations regulate the organization, operation and supervision of the appointment of the members of the Permanent Consultation of Public Games authorized in the country.

The agency operates within the scope of the Customs and Monopolies Agency (ADM) and aims to monitor the evolution of public gambling activities, providing an institutional space to analyze the development of the sector and its main challenges.

Institutional representation and participation of the sector

The decree establishes a composition of 14 members, in addition to its president, with representation from different public bodies and actors linked to the industry. These include representatives of ministers, the ADM, the Guardia di Finanza, regions and municipalities, as well as concessionaires, consumer associations and other sectors related to public gambling.

The members are appointed by decree of the Ministry of Economy and Finance and serve for a period of three years. The regulations also establish procedures for convening meetings, adopting decisions and organizing working groups on specific issues.

In addition, the Consultation may call on specialists, universities, research centers and scientific entities to deepen the analysis of certain topics.

Monitoring and evaluation of gambling policies

Among the planned functions are the monitoring of market developments, the collection of relevant data and the preparation of annual reports for the Ministry of Economy and Finance. These activities seek to contribute to a more systematic evaluation of public policies related to the sector.

The agency will also be able to facilitate exchange between institutions and industry representatives, in a market that requires coordination between state supervision, economic interests and the protection of users.

The decree establishes that its members will not receive remuneration, allowances or reimbursements for their participation, and that the operation of the Consultation must be developed without generating new expenses for public finances.

In addition, the decree also highlights that the creation of the Consultation aims to "monitor the evolution of gambling activities", reinforcing the institutional monitoring of the sector in Italy. The agency operates within the scope of the Customs and Monopolies Agency (ADM), in accordance with the provisions of Legislative Decree No. 41, of March 25, 2024.

A new step in Italian regulatory reform

The entry into force of Ministerial Decree No. 90/2026 represents a step forward in the implementation of Legislative Decree No. 41/2024, which laid the groundwork for reorganising the public gaming sector, starting with the online market.

With this new monitoring structure, Italy seeks to improve the analysis of the activity and strengthen coordination between the different actors involved in the regulation.

In short, for operators and providers in the area, the evolution of this framework will be relevant to understand regulatory priorities and anticipate the next steps of the Italian authorities in terms of supervision, transparency and development of the legal gambling market.
