(Viña del Mar).- The Chilean operator has filed a petition before the Tribunal for the Defense of Free Competition, questioning the design of the bidding rules set by the Superintendence of Casinos and requesting the suspension of the Viña del Mar process.

Legal Action Before the Competition Tribunal

Inversiones Marina del Sol SA, which operates casinos in Calama, Chillán, Talcahuano, and Osorno, submitted a consultation to the Tribunal de Defensa de la Libre Competencia (TDLC). The company seeks to determine whether the technical bases prepared by the Superintendence of Casinos de Juego (SCJ) for the tenders of Iquique, Coquimbo, Viña del Mar, and Pucón comply with the requirements of DL 211, the law that regulates free competition in Chile.

Concerns Over Transition Periods

Specifically regarding Viña del Mar, Marina del Sol requested that the tribunal suspend the process due to concerns until the consultation is resolved. The operator argues that the bidding design creates a serious problem in the transition conditions between the outgoing operator and the new concessionaire. The rules stipulate that the casino’s operational plan “may not exceed three months from the moment the property is made available to the awardee.”

Impact on Competition

Although the Casino Law establishes a maximum of two years for the awardee to implement its project, Marina del Sol warns that setting such a short administrative deadline for a casino operating in third-party infrastructure constitutes an exercise of discretion. In practice, this restriction excludes any operator that is not the incumbent or has not previously acquired the assets, thereby unjustifiably limiting competition in advance.
