New York lawmakers are moving to dramatically reshape the state’s betting landscape with a proposal that would prohibit all forms of live, or in-play, wagering—a move that could significantly disrupt the rapidly expanding esports betting market.

Assembly member Linda Rosenthal has introduced Bill A9343, which seeks to bar casinos, mobile sportsbooks, and licensed operators from accepting any in-play bets from New York residents. While the measure applies broadly to sports betting, its impact would be particularly acute for esports, where live wagering has become central to user engagement and market growth.

Live betting currently represents roughly half of all sports wagers placed in the United States. By targeting this segment, the proposal goes far beyond incremental regulation, striking at one of the industry’s most lucrative and technologically advanced offerings.

Public Health Concerns Drive Legislative Push

Rosenthal frames the bill primarily as a consumer protection measure, citing growing concerns around problem gambling and the psychological risks associated with fast-paced betting environments.

“New York state has an obligation to protect consumers and address concerning public health trends,” she wrote in the bill’s justification, arguing that live betting encourages impulsive behavior and continuous wagering cycles.

Esports, with its rapid-fire events and constantly shifting odds, has drawn particular attention. Recent reports highlighting algorithmic trading activity—such as a betting bot that reportedly turned a modest stake into a six-figure return through live bets on League of Legends and Dota 2—have amplified fears around both compulsive gambling and market manipulation.

Lawmakers point to these extreme outcomes as evidence that real-time betting environments may amplify risk, especially when outcomes can pivot within seconds.

Economic Impact and Industry Fallout

The financial stakes surrounding the proposal are substantial. New York is the largest sports betting market in the U.S., with nearly $24 billion wagered during fiscal year 2024. Projections suggest total handle could surpass $25 billion in 2025.

Industry estimates indicate that live betting alone may account for more than $10 billion of that volume. At New York’s headline-grabbing 51 percent tax rate, the potential loss of in-play wagering could translate into more than $1 billion in forgone annual tax revenue.

The bill has been referred to the Assembly Racing and Wagering Committee, where it will face debate alongside other gambling-related measures. Notably, separate legislation aimed at prediction markets such as Polymarket is also advancing, signaling a broader effort to rein in emerging and non-traditional betting formats.

A Bellwether for the U.S. Market?

For esports bettors accustomed to wagering on every pivotal in-game moment, the proposal could mark a fundamental shift in how—and whether—live esports betting operates in New York. More broadly, the outcome of A9343 may resonate far beyond state borders.

As one of the most influential regulated betting markets in the country, New York often sets the tone for national policy discussions. Should the ban advance, other states may be encouraged to pursue similar restrictions, potentially reshaping the future of live esports wagering across the U.S.

Whether the bill gains enough political momentum to pass remains uncertain. What is clear, however, is that New York’s lawmakers are signaling a tougher stance on high-speed betting—one that could redefine the balance between innovation, revenue, and consumer protection in the gaming industry.
