New Zealand Tightens Online Casino Rules as DIA Advances Licensing Rollout

With the Online Casino Gambling Act 2026 (OCGA) now in force as of 1 May 2026, the Department of Internal Affairs (DIA) has moved into the next stage of implementation, issuing updated guidance on timelines, licensing procedures, and the structure of the upcoming market entry process.

A key immediate change is the enforcement of a strict ban on advertising unlicensed online casino gambling under Section 10 of the Act. While existing legislation already restricted offshore operators from promoting services in New Zealand, the OCGA significantly strengthens enforcement powers. The DIA can now issue take-down notices and impose financial penalties of up to $5 million for non-compliance.

Operators have been urged to maintain full compliance during the transition period, as past conduct may influence licensing outcomes under the new regime.

Looking ahead, the expression of interest (EoI) phase is expected to open in July 2026, once detailed operational regulations are finalized. This stage will provide further clarity on eligibility criteria and application requirements, forming the foundation for a competitive licensing process expected to include an auction format.
