The rights of gamblers in Brazil are protected by the Secretariat of prizes and gambling and the Senacon

(Brasilia).- The Secretariat of Prizes and Gambling (SPA) of the Brazilian Ministry of Finance and the National Secretariat of Consumers (Senacon) of the Ministry of Justice and Public Security, signed a Technical Cooperation Agreement (ACT) to protect the rights of bettors.
Within the regulated fixed-odds betting market, composed of fixed-odds betting operators, bettors' rights will be guaranteed to prevent and mitigate negative externalities in this sector.
The SPA and Senacon have committed to produce informative materials on consumer rights in this entertainment market, both with guidelines aimed directly at gamblers and to instruct members of the National Consumer Defence System, made up of state and municipal Procons, defence offices, public prosecutors' offices and civil consumer defence entities.
Joint initiatives are also planned with Senacon's National School of Consumer Defence, promoting training and guidance aimed at raising awareness among gamblers. As part of the commitment made in the ACT, it is worth highlighting the reinforcement of the requirement for all betting companies to participate in the Consumidor.gov.br platform. In addition to increasing consumer protection, this measure will also serve as a control tool for the SPA, allowing it to closely monitor the activities of companies in the market.
The two secretariats are committed to a constant exchange of information to help make the work of the partners more effective. This joint action will enable more effective monitoring of practices in the sector and the protection of players' rights.
‘The SPA's partnership with Senacon is an important tool for one of the pillars of fixed odds betting regulation, which is the guarantee of bettors' rights. In a market as new as this one, providing information to people is especially important,’ said Regis Dudena, Secretary for Prizes and Gambling.
For the National Secretary for Consumer Affairs, Wadih Damous, ‘ACT reinforces Senacon's commitment to consumer protection, ensuring that gamblers have their rights respected and have access to effective protection mechanisms’. He also highlighted that, in addition to the requirement to join the Consumidor.gov.br platform, the agreement provides for the creation of a direct communication channel between the SPA and consumer protection bodies, allowing for the rapid identification of complaint patterns and possible irregularities in the sector.
This strategic cooperation aims not only to strengthen law enforcement, but also to foster a safer and more transparent betting environment in order to prevent abuses and ensure that companies operate in compliance with the current legislation.
Fixed odds betting is a form of lottery that was legalised as a public service in December 2018, extended by Law 14.790/2023 and regulated by various SPA Ordinances from 2024. Last year there was a transition period for companies to adapt to the new regulations. On 1 January this year the regulation came into force and only licensed companies can offer their services. One of the rules is the use of the ‘.bet.br’ extension, which is exclusive to authorised sites,
