Strict Legal Framework for Social Betting in Germany
The Joint Gaming Authority of the States (GGL) highlights its expanding informational resources regarding social bets and prediction markets. Through a newly launched FAQ section on its website, the GGL aims to answer frequently asked questions and clarify the legal landscape.
The authority explicitly states that social bets—wagers placed on the outcome of social, political, economic, or other events—are not eligible for licensing under German gambling law. Therefore, participating in these activities from within Germany is strictly prohibited and can be a punishable offense. For players, this means that placing such a bet from Germany could result in criminal liability. Furthermore, organizing or mediating these types of bets can also lead to criminal prosecution.
Operator Requirements and Media Guidelines
When conducting a legal assessment of a specific betting offer, the GGL emphasizes that the actual design and its accessibility to users in Germany must always be taken into account. For regulatory purposes, it matters whether the platform is accessible to individuals in Germany and allows them to participate. If a provider effectively excludes German participants and successfully blocks its services from the German market, the platform does not automatically constitute an illegal gambling operation within the country.
Additionally, the GGL provided guidance regarding media coverage of social bets and prediction markets. While media outlets are generally permitted to report on related developments and forecasts journalistically, they are urged to inform their audiences. The GGL advises that readers should be explicitly made aware that social bets are not permissible in Germany and that participating from within the country is illegal.
